On October 19, the Guandu District Joint Investigation Team issued a report: On October 16, in response to the food safety issues at Changfeng School in Guandu District, Kunming City, Guandu District organized market supervision, education, public security, agriculture and rural areas, health and other departments to form a joint investigation team to conduct an investigation based on the principle of seeking truth from facts. The relevant situation is now reported as follows.

1. Investigation of the odor of fresh pork slices in the school cafeteria and the production date of imported frozen meat

Yunnan Runsheng Property Service Co., Ltd., the contractor and operator of the Changfeng School cafeteria, commissioned Yunnan Caiyunjian Catering Management Co., Ltd. as the food supplier on October 13.

In response to parents' complaints about the smell of fresh pork slices in the cafeteria on October 16, the third-party professional institutions Kunming Food and Drug Inspection Institute and Yunnan Sanzheng Technology Testing Co., Ltd. conducted simultaneous inspections and found that the volatile basic nitrogen index (23.8mg/100g) of this batch of fresh pork slices exceeded the national standard (¨Q15mg/100g), and was judged to be unqualified. Upon investigation, this batch of fresh pork was slaughtered on October 16, and the origin quarantine certificate and "two certificates and two stamps" were complete. In the early morning of the same day, after being sliced by machine, it was not heat-dissipated and packaged in double-layer plastic bags. It was stored in plastic bags for nearly 4 hours and then placed at room temperature in the cafeteria for 5 and a half hours. It was not transported by cold chain or refrigerated, and it became spoiled and smelly due to improper transportation and storage.

Regarding the problem of "expired imported frozen beef with the words 2015" reported by parents, after investigation, according to the customs declaration form and the quarantine and inspection certificate of imported goods, the production date of this batch of imported frozen beef is May 2024, with a shelf life of 2 years. The words "2015SIF" on the packaging label are the registration number of the overseas manufacturer of imported food, not the production date.

II. Investigation of the legality and compliance of the external contracting management of school canteens and the canteen contracting and operating enterprises

Changfeng School in Guandu District is a joint-stock private full-time middle school. The school is organized by Yunnan Jinnuo Education Investment Holding Group Co., Ltd. and was established in 2016.

Changfeng School commissioned Yunnan Runsheng Property Service Co., Ltd. to contract and operate the canteen in August 2024, but failed to report to the higher-level education authorities as required. Changfeng School did not properly review and manage the business qualifications of the canteen contracting and operating enterprises, and there were problems of "contracting instead of management" and "one-time contracting", and the management system became a formality. The school principal failed to fulfill the responsibility of the first person responsible for food safety, failed to equip food safety management personnel as required, and failed to provide adequate training for employees.

After investigation, Yunnan Runsheng Property Service Co., Ltd. has a business license and a food business license, but the license only allows for the sale of pre-packaged food and bulk food. It does not have the qualifications to engage in catering services. The operation of the school canteen is a change in business items. It did not apply for additional business items in accordance with regulations and cannot be the main body of the canteen. During the operation of the canteen, the food safety management system was not implemented in place, and the purchase inspection and food storage management were improper.

III. Disposal Opinions

(I) Changfeng School

1. In accordance with the law, a case investigation will be filed against Yunnan Jinnuo Education Investment Holding Group Co., Ltd., the organizer of Changfeng School, and the legal representative of the school for failing to fulfill their main responsibilities for running the school.

2. The principal and legal representative of Changfeng School will be removed from their posts in accordance with the law.

3. Instruct Changfeng School to reorganize the board of directors according to law, revise and improve the board charter, strengthen the performance of duties and run the school according to law. Guide the school to improve and implement the democratic school management system such as the participation of the faculty and staff representative conference and the parent committee in major decision-making and school affairs disclosure.

4. Order Changfeng School to establish and improve the campus food safety supervision mechanism, effectively implement the system of school leaders accompanying meals, and support student parent representatives to accompany meals.

5. In accordance with the relevant provisions of the "Food Safety Law of the People's Republic of China", Changfeng School is ordered to correct its behavior of failing to perform its food safety management responsibilities in accordance with regulations and give a warning; the school is fined 100,000 yuan for operating unqualified food.

6. The municipal and district education departments set up a special working group on campus to strengthen guidance and inspection, ensure the normal education and teaching order of the school, and ensure the teaching quality and stability of the teaching staff.

(II) To the enterprises involved

7. In accordance with the relevant provisions of the "Food Safety Law of the People's Republic of China" and the "Food Business License and Registration Management Measures", the canteen contractor Yunnan Runsheng Property Service Co., Ltd. was ordered to stop operating, confiscate illegal income of 460,000 yuan, and impose a fine of 5.68 million yuan for its failure to apply for changes in accordance with the regulations; it was ordered to correct its behavior of operating unqualified food and was fined 100,000 yuan.

8. The food supplier Yunnan Caiyunjian Catering Management Co., Ltd. was ordered to stop operating, accept investigation, and be punished according to the results of the investigation.

(III) To the relevant units and cadres

9. The Kunming Municipal Commission for Discipline Inspection and Supervision will supervise and investigate the relevant departments and cadres. At present, the director of the District Education and Sports Bureau, the deputy director in charge of the District Education and Sports Bureau, and the deputy director in charge of the District Market Supervision and Administration Bureau have been suspended for inspection.
