Special campaign to combat excessive packaging of tea
According to the WeChat public account "Shi Shuo Xin Yu", in order to implement the decisions and arrangements of the CPC Central Committee and the State Council on the governance of excessive tea packaging, in April 2023, the State Administration for Market Regulation, together with the National Development and Reform Commission, the Ministry of Industry and Information Technology, the Ministry of Agriculture and Rural Affairs, the Ministry of Commerce, and the China Supply and Marketing Cooperatives, launched a one-year special campaign to combat excessive tea packaging. As of the end of October 2023, China's market supervision departments have inspected 290,000 tea production and operation units, ordered 3,156 to correct their mistakes, and filed 333 cases for investigation and punishment, achieving important results in governance. In order to further play the educational and warning role of the case, some typical cases of investigating and correcting excessive packaging of tea will be announced one after another. The first batch of 20 cases are now announced as follows:
1. The Market Supervision Bureau of Guangling District, Yangzhou City, Jiangsu Province investigated and dealt with the case of Yangzhou Hongchang Tea Co., Ltd. producing and selling tea with excessive packaging void ratio
On October 7, 2023, the Market Supervision Bureau of Guangling District, Yangzhou City, Jiangsu Province imposed an administrative penalty of 2,000 yuan on Yangzhou Hongchang Tea Co., Ltd. (hereinafter referred to as the party) for failing to comply with the mandatory standards for restricting excessive packaging of goods and refusing to correct the behavior.
In January 2022, the party was ordered to correct by the Market Supervision Bureau of Guangling District, Yangzhou City for producing and selling over-packaged Biluochun (production date: 20210428, net content 100g×2). From April to June 2023, the market supervision department found three times during the supervision and random inspection that the void ratio of the packaging of the two teas, Biluochun and Jinjunmei, produced and sold by the party at different times exceeded the standard. On March 29, 2023, the Shanghai Pudong New Area Market Supervision Bureau found that the void ratio of the packaging of Biluochun (production date: 20230209) produced by the party was 56%; on May 5, 2023, the Shanghai Municipal Market Supervision Bureau found that the void ratio of the packaging of Biluochun (production date: 20221201) produced and sold by the party was 61%; on June 14, 2023, the Wuxi Xinwu District Market Supervision Bureau found that the void ratio of the packaging of Jinjunmei (production date 20230209) produced and sold by the party was 50%. The above three teas do not meet the requirements of GB23350-2009 "Requirements for Restricting Excessive Packaging of Commodities for Food and Cosmetics" regarding "the void ratio of other foods in packaging ≤45%".
The party's behavior violated the provisions of Article 68, paragraph 2 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Waste", and was an act of producers and operators failing to comply with the mandatory standards for limiting excessive packaging of goods and refusing to correct it as stipulated in Article 105 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Waste". The Guangling District Market Supervision Bureau imposed administrative penalties in accordance with Article 105 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Waste".
2. Wu'an City Market Supervision Bureau of Hebei Province investigated and dealt with the case of Cui Luyutao Daily General Store in Cishan Town, Wu'an City, selling tea with excessive packaging void ratio
On October 23, 2023, the Wu'an City Market Supervision Bureau of Hebei Province imposed an administrative penalty of 2,000 yuan on Cui Luyutao Daily General Store in Cishan Town, Wu'an City (hereinafter referred to as the party) for failing to comply with the mandatory standards for limiting excessive packaging of goods and refusing to correct it.
On September 19, 2023, the Wu'an Municipal Market Supervision Bureau found in a special inspection on excessive packaging of goods that the rectangular "HUICAI" green tea gift boxes (net content: 5g*6 bags) being sold by the party concerned were 400mm in length, 230mm in width, and 110mm in height, respectively. The sales packaging volume was 10120000mm3, and the total volume of the contents was 30000mm3. The calculated packaging void ratio was 96.1%, which did not comply with GB23350-2021 "Requirements for Restricting Excessive Packaging of Goods for Food and Cosmetics". ¡· Regarding "single piece net content 1g"
The party's behavior violated the provisions of Article 68, paragraph 2 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes", and fell under the situation stipulated in Article 105 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes" that the producer and operator failed to comply with the mandatory standards for restricting excessive packaging of goods and refused to correct it. Wu'an Municipal Market Supervision Bureau imposed administrative penalties in accordance with Article 105 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes".
3. The Pingyang County Market Supervision Bureau of Zhejiang Province investigated and dealt with the case of Pingyang County Fudaojia Tea Business Department selling tea with excessive packaging layers.
On November 8, 2023, the Pingyang County Market Supervision Bureau of Zhejiang Province imposed an administrative penalty of 2,500 yuan on the Pingyang County Fudaojia Tea Business Department (hereinafter referred to as the party) for failing to comply with the mandatory standards for restricting excessive packaging of goods and refusing to correct the behavior.
On September 22, 2023, the Pingyang County Market Supervision Bureau found in a special inspection on excessive packaging of tea that the Baihao Yinzhen tea gift box (net content/specification: 250 grams) sold by the party had five layers of packaging from the outside to the inside, namely a transparent plastic sealing layer, a square wooden box, a translucent plastic packaging bag, a ceramic jar, and a tea bag plastic sealing layer, which did not comply with GB23350-2021 "Requirements for Restricting Excessive Packaging of Goods". In accordance with the provisions of the "Food and Cosmetics Law" that "grain and its processed products should not exceed three layers, and other commodities should not exceed four layers", a "Notice of Correction" was issued on the spot to require the party to stop selling and remove the relevant products from the shelves. On October 7, 2023, a review found that the party was still selling the above-mentioned tea gift boxes.

4. The Market Supervision Bureau of Qingliu County, Fujian Province investigated and dealt with the case of Wanyan Trading Company in Longjin Town, Qingliu County, selling tea with excessive packaging void ratio.

On September 4, 2023, the Qingliu County Market Supervision Bureau found in a special inspection of excessive packaging of goods that the "Fang'an" bamboo nest narcissus tea gift box (net content: 9g×6) sold by the party had three layers of packaging, and the length, width and height of the rectangular packaging box were 251mm, 180mm and 45mm respectively. After manual on-site measurement, the packaging void ratio was 65.47%, which did not meet the requirements of GB23350-2021 "Requirements for Restricting Excessive Packaging of Goods for Food and Cosmetics" regarding "single piece net content 5g"

5. Taishan District Market Supervision Bureau of Tai'an City, Shandong Province Investigates and Deals with the Case of Wu Yue Fresh Supermarket in Taishan District Selling Tea with Excessive Void Rate in Packages

On September 1, 2023, the Taishan District Market Supervision Bureau conducted a special inspection on excessive packaging of goods and found that the "Fujian Mingcha" gift box sold by the Party contained 8 cans of canned tea, each weighing 30 grams. After manual on-site measurement, the length, width, and height of the gift box were 37.5cm, 26cm, and 8cm respectively, and the packaging The void ratio is 60%, which does not meet the requirements of GB23350-2021 "Requirements for Restricting Excessive Packaging of Goods for Food and Cosmetics" regarding "for single items with a net content of 15g50g, the void ratio is ≤30%".

6. Shimian County Market Supervision Bureau of Sichuan Province investigates and punishes the case of Ye Bo RT-Mart Supermarket in Shimian County selling tea with excessive void ratio in packaging

7. Chongyang County Market Supervision Bureau of Hubei Province investigates and punishes Chongyang County Huijin Supermarket Jinyang Store for selling tea with excessive void ratio

On September 12, 2023, during a special inspection on excessive packaging of goods, Chongyang County Market Supervision Bureau found that the "Qingzhuan 7 Tea" tea sold on the shelf of the party was packaged in four layers from the inside to the outside, namely, independent plastic bags, independent small paper boxes, paper boxes, and sealed handbags. It was also found that the specification of the tea was 8g*3 bags, and the length, width and height of the rectangular packaging box were 270mm, 200mm and 60mm respectively. After on-site verification, it was found that the "Nayong High Mountain Tea" (net content: 150 grams/box) produced and sold by the party was sold at a price of 320 yuan/box, and the purchase price of the outer packaging box was 150 yuan/piece. The Bijie Municipal Market Supervision Bureau ordered immediate rectification and removal of relevant products from shelves and stopped sales in accordance with Article 105 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes".
9. Ningxia Hui Autonomous Region Yongning County Market Supervision Bureau corrects Yongning County Wangyuan Town Baiming Specialty Products Wholesale Department for selling tea with excessive packaging costs
On September 28, 2023, the Ningxia Hui Autonomous Region Yongning County Market Supervision Bureau ordered Wangyuan Town Baiming Specialty Products Wholesale Department (hereinafter referred to as the party) to correct its failure to comply with the mandatory standards for restricting excessive packaging of goods. On October 15, 2023, after review, the party has made rectifications.
On September 28, 2023, Yongning County Market Supervision Bureau During the special inspection of excessive packaging of goods, the Administration found that the price of the eight-treasure tea sold by the party was 80 yuan/box. The purchase receipt of the gift box provided by the party reflected that the party purchased the gift box packaging at a price of 25 yuan/box. The party's behavior violated the provisions of Article 68, paragraph 2 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes", and constituted an act of the producer and operator failing to comply with the mandatory standards for restricting excessive packaging of goods. In accordance with Article 105 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes", the Yongning County Market Supervision Bureau ordered the rectification of the above-mentioned illegal acts and the removal of related products from the shelves and the cessation of sales.
10. The Xinjiang Uygur Autonomous Region Jinghe County Market Supervision Bureau corrected the behavior of Jinghe County Bajiahu Guanghui Supermarket selling tea with excessive packaging layers and packaging void ratio

The parameters of the rectangular outer packaging were 200mm*100mm*73mm. After manual on-site measurement, the void ratio was 95.7%, which did not comply with the requirements of GB23350-2021 "Requirements for Restricting Excessive Packaging of Goods for Food and Cosmetics" regarding "grain and its processed products, moon cakes and rice dumplings should not exceed three layers, and other goods should not exceed four layers" and "single item with a net content of 2≤1g, and a void ratio of ≤85%".
The party¡¯s behavior violated the provisions of Article 68, Paragraph 2 of the ¡°Law of the People¡¯s Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes¡±, and constituted an illegal act of the producer and operator failing to comply with the mandatory standards for restricting excessive packaging of goods. The Jinghe County Market Supervision Bureau ordered the party to immediately correct the above illegal behavior and remove the relevant products from the shelves and stop selling them in accordance with Article 105 of the ¡°Law of the People¡¯s Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes¡±.
11. The Market Supervision Bureau of Yangquan City, Shanxi Province corrected the behavior of Yangquan Xiandeju Leisure Entertainment Co., Ltd. in selling tea with excessive void ratio in packaging
On October 16, 2023, the Market Supervision Bureau of Yangquan City, Shanxi Province ordered Yangquan Xiandeju Leisure Entertainment Co., Ltd. (hereinafter referred to as the party) to correct its failure to comply with the mandatory standards for restricting excessive packaging of goods. On October 24, 2023, after re-examination, the party has made rectifications.
On August 30, 2023, during a special law enforcement inspection on excessive packaging of goods, Yangquan Municipal Market Supervision Bureau sampled and inspected the "Hongrun Dongfang¡¤Qimen Black Tea" (net content: 50 grams, production date: 2022.08.29) sold by the party concerned and found that the void rate of the tea packaging was 83.74%, which did not meet the requirements of "single piece net content 30g" in GB23350-2021 "Requirements for Restricting Excessive Packaging of Goods for Food and Cosmetics"
The party concerned's behavior violated the provisions of Article 68, paragraph 2 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes", and constituted an act of the producer and operator failing to comply with the mandatory standards for restricting excessive packaging of goods. In accordance with Article 105 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes", Yangquan Municipal Market Supervision Bureau ordered the party concerned to immediately correct the above-mentioned illegal behavior and remove the relevant products from the shelves and stop selling them.
12. The Chifeng Municipal Market Supervision Bureau of the Inner Mongolia Autonomous Region corrected the behavior of Chifeng Weilehui Supermarket Co., Ltd. Wanda Plaza Store in Hongshan District selling tea with excessive packaging void ratio.
On October 12, 2023, the Chifeng Municipal Market Supervision Bureau of the Inner Mongolia Autonomous Region ordered Chifeng Weilehui Supermarket Co., Ltd. Hongshan District Wanda Plaza Store (hereinafter referred to as the party) to correct its failure to comply with the mandatory standards for restricting excessive packaging of goods. On October 18, 2023, after review, the party has rectified the situation.
On September 19, 2023, the Chifeng Municipal Market Supervision Bureau conducted a special inspection on excessive packaging of goods and conducted random inspections on the Tieguanyin (specification: 200g*2 barrels, production date 2023-07-18) sold by the party. It was found that the void ratio of the tea packaging was 45.0%, which did not meet the requirements of GB23350-2021 "Requirements for Restricting Excessive Packaging of Goods for Food and Cosmetics" regarding "void ratio ≤30% for single item net content Q>50g".
The party's behavior violated the provisions of Article 68, paragraph 2 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes", and constituted an act of the producer and operator failing to comply with the mandatory standards for restricting excessive packaging of goods. The Chifeng Municipal Market Supervision Bureau ordered the party to immediately correct the above-mentioned illegal behavior in accordance with Article 105 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes" and to stop selling the relevant products.
13. The Dalian Municipal Market Supervision Bureau of Liaoning Province corrected the behavior of China Resources (Dalian) Co., Ltd. Grand Hyatt Hotel selling tea with excessive packaging void ratio
On November 3, 2023, the Dalian Municipal Market Supervision Bureau of Liaoning Province ordered the Grand Hyatt Hotel of China Resources (Dalian) Co., Ltd. (hereinafter referred to as the party) to correct its failure to comply with the mandatory standards for restricting excessive packaging of goods. On November 14, 2023, after re-examination, the party has made rectifications.
On September 12, 2023, the Dalian Municipal Market Supervision Bureau found in the tea product quality supervision spot check that the "Rainforest Songfu (Rainforest Black Tea Loose Tea) Specification: 160g (40g×4)" tea gift box sold by the party was suspected of being over-packaged. After entrusting a third-party testing agency to test the above-mentioned tea gift box, the packaging void rate of this tea gift box was 84.57%, which did not meet the requirements of GB23350-2021 "Requirements for Restricting Excessive Packaging of Goods for Food and Cosmetics" regarding "single piece net content 30g"
The party's behavior violated the provisions of Article 68, paragraph 2 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes", and constituted an act of the producer and operator failing to comply with the mandatory standards for restricting excessive packaging of goods. The Dalian Municipal Market Supervision Bureau ordered the party to immediately correct the above-mentioned illegal behavior and remove the relevant products from the shelves and stop selling them in accordance with Article 105 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes".
14. The Market Supervision Bureau of Sanmenxia City, Henan Province corrected the behavior of Cha Qingxiu Tea Sales Department in Hubin District selling tea with excessive packaging void ratio
