The General Administration of Customs publishes typical cases of intellectual property protection

2024 marks 30 years of IPR customs protection, and the General Administration of Customs (GAC) recently released typical cases of Chinese customs in protecting intellectual property rights and cracking down on infringement. Not long ago, Kunming Customs seized two cases of infringement of intellectual property rights through export channels.

In April this year, customs officers found an anomaly in a box of goods declared as "mobile phone cases" at Yonghe Port in Yunnan Province. After unpacking inspection, 129 sets of mobile phone chargers were found under the declared mobile phone case, printed with the graphic trademark of well-known mobile phones in China and abroad, and the parties could not provide the legal source and authorization of the goods, suspected of infringement.

Kunming Customs Cangyuan Customs port supervision officer Wang Li said: "From the perspective of appearance alone, the batch of infringing goods are almost identical with the genuine goods, but the two-dimensional code and serial number on the outer package can not be identified. After investigation, they are infringing goods. If used for a long time, there may be hidden dangers such as fire caused by short circuit. If sold to foreign markets, they may also damage the interests of consumers and right holders."

Similarly, at Mohan Highway port in Yunnan Province, customs officers unpacking a cargo declared as "Baijiu" found that 108 bottles of baijiu with the graphic trademark of "Kweichow Moutai" were suspected of violating the intellectual property rights registered by the right holder in the General Administration of Customs.

At present, the customs has confiscated the infringing goods according to law, and the subsequent destruction will be processed. As an inbound and outbound supervision and administration organ, the Customs plays an important role in the protection of intellectual property rights in import and export. According to the Regulations of the People's Republic of China on Customs Protection of Intellectual Property Rights, the Customs shall investigate and handle import and export goods that infringe upon the exclusive right to use trademarks, Copyrights and patents protected by Chinese law. In the first quarter of this year, Kunming Customs seized 20,500 pieces of goods suspected of infringing intellectual property rights, worth 141,000 yuan.

Ningbo Customs to combat import and export infringement to safeguard the interests of enterprises

Zhejiang is China's traditional foreign trade province. In recent years, Ningbo Customs has continuously strengthened the protection of independent intellectual property rights and cracked down on import and export infringement in view of the local industrial clusters and many foreign trade enterprises. Recently, the Beilun Customs of Ningbo Customs seized an injection molding machine that infringed the trademark rights of local enterprises in the export link. The customs officers found on the spot that the injection molding machine was printed with obvious trademarks. However, the technical personnel of all enterprises have repeatedly confirmed that this injection molding machine is unauthorized for an enterprise to renovate and transform the old machine, forge trademarks, nameplates, etc., and falsely report it as a new machine without a brand, in an attempt to evade customs supervision.

According to statistics, from 2023 to the first quarter of this year, Ningbo Customs has seized 97 cases of infringement of various independent intellectual property rights, seized 1.186 million pieces of infringing goods, and the value of the goods involved reached 3.738 million yuan.

In addition to protecting the intellectual property rights of local brands in the export link, the customs also strictly supervises the import link to prevent the inflow of infringing goods into China. Recently, Daxie Customs under Ningbo Customs seized a case of infringement of imported vehicle parts, seized 2,579 pieces of infringing parts, involving 9 well-known brands, prevented these fake and shoddy vehicle parts from flowing into the market, and put an end to the possible danger to vehicle performance and driving safety.
