Ministry of Emergency Management: Revised work safety law toughens punishment up to 100 million yuan

At the meeting, Song Yuanming, Vice minister of the Ministry of Emergency Management, introduced that on June 10, the Standing Committee of the National People's Congress voted to adopt the decision on amending the Work Safety Law of the People's Republic of China, which will come into force on September 1, 2021.
Song Yuanming said that the revised work safety law will increase the severity of punishment for violations. First, the fines will be higher. The revision generally raises the amount of fines for violations, from 200,000 to 20 million yuan under the current law to 300,000 to 100 million yuan for accidents; The amount of accident fines for the principal person in charge of the unit was increased from 30 to 80 percent of annual income to 40 to 100 percent. Second, the penalties will be stricter. For example, if a production or business entity fails to take measures to eliminate hidden dangers of accidents, it shall be ordered to make rectification first, refuse to make rectification and then be ordered to suspend production and business for rectification and a fine as provided for in the existing law. This has been amended to read: Once the illegal acts are discovered, rectification shall be ordered and a fine shall be imposed on the entity who refuses to make rectification and shall be ordered to suspend production and business for rectification and may be fined on a daily basis for those who refuse to stop production and business for rectification. The local people's government shall be requested to close down the operation. Third, the punishment should be stronger. Joint punishment and disclosure of violations and breaches of trust have been strengthened, and joint punishment measures such as increasing the frequency of law enforcement, suspending project approval, raising insurance rates, and banning entry into industries or professions have been added. Through the ""sword hanging high"", we have effectively cracked down on illegal enterprises and protected the legitimate rights and interests of law-abiding enterprises.
According to Song Yuanming, the current work safety law was enacted in 2002, and has been revised twice in 2009 and 2014. This is the third revision, Song said. The law has played an important role in preventing and reducing workplace accidents and ensuring the safety of people's lives and property. The number of fatalities from work safety accidents in China has dropped from 140,000 in 2002 to 27,100 in 2020, a decrease of 80.6 percent. The number of major accidents dropped from the peak of 140 in 2001 to 16 in 2020, a drop of 88.6 percent.
