Typical cases of special campaign to combat excessive packaging of tea

According to the "Shi Shuo Xin Yu" public account, in order to continue to promote the special governance action on excessive packaging of tea, according to the work arrangement, the fourth batch of 20 typical cases are now announced.

1. Guangzong County Market Supervision Bureau of Hebei Province investigates and punishes Guangzong County Mingyuexuan Tea House for selling tea with excessive packaging void ratio

On January 28, 2024, Guangzong County Market Supervision Bureau of Hebei Province imposed an administrative penalty of 2,000 yuan on Guangzong County Mingyuexuan Tea House (hereinafter referred to as the party) for failing to comply with the mandatory standards for restricting excessive packaging of goods and refusing to correct the behavior.

On January 6, 2024, the Guangzong County Market Supervision Bureau conducted a special inspection on excessive packaging of goods and found that the rectangular "Mingqian Longjing Green Tea Gift Box" sold by the party through the Kuaishou platform (Kuaishou account: Mingyuexuan Tea House, 1225538131) contained 2 boxes of boxed tea, each weighing 200 grams. After manual on-site measurement, the length, width and height of the gift box were 36.4cm, 14cm and 28cm respectively, and the packaging void ratio was 63.6%, which did not meet the requirements of GB23350-2021 "Requirements for Restricting Excessive Packaging of Goods for Food and Cosmetics" regarding "For single unit net content Q£¾50g, the packaging void ratio shall be ≤30%". A "Notice of Correction" was issued on the spot, requiring the party to immediately correct the illegal behavior and remove it from the shelves. On January 15, 2024, the re-inspection found that the "Wuyi Rock Tea Dahongpao" gift box (producer: Wuyishan Hongri Rock Tea Factory) being sold by the party contained 2 boxes of boxed tea, each weighing 150 grams. After manual on-site measurement, the length, width and height of the gift box were 27cm, 18cm and 20.1cm respectively, and the packaging void ratio was 60.1%, which did not meet the requirements of GB23350-2021 "Requirements for Restricting Excessive Packaging of Goods for Food and Cosmetics" regarding "single piece net content Q>50g, packaging void ratio ≤30%".

The party's behavior violated the provisions of Article 68, paragraph 2 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes", and was an act of producers and operators failing to comply with the mandatory standards for restricting excessive packaging of goods and refusing to correct it as stipulated in Article 105 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes". The Guangzong County Market Supervision Bureau imposed administrative penalties in accordance with Article 105 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes".

2. Jiangsu Yixing Municipal Market Supervision Bureau investigates Yixing Hongling Tea Factory for producing and selling tea with excessive packaging void ratio

On January 18, 2024, Jiangsu Yixing Municipal Market Supervision Bureau imposed an administrative penalty of 2,000 yuan on Yixing Hongling Tea Factory (hereinafter referred to as the party) for failing to comply with the mandatory standards for restricting excessive packaging of goods and refusing to correct the behavior.

On April 28, 2023, Yixing Municipal Market Supervision Bureau preliminarily determined during the inspection that the void ratio of the Yixing black tea gift box (specification: 125g x 2) produced and sold by the party itself was above 50%, which was suspected of constituting excessive packaging. Afterwards, Anhui Qingxi Testing Technology Co., Ltd. was commissioned to conduct a sampling inspection. The inspection conclusion showed that the tea gift box was 450mm long, 260mm wide, and 90mm high, with a packaging void ratio of 56.9%, which did not meet the requirements of GB23350-2009 "Requirements for Restricting Excessive Packaging of Commodities, Food and Cosmetics" regarding "Packaging void ratio of other foods ≤45%". The law enforcement officers issued a "Notice of Correction" on the spot, requiring the party concerned to immediately correct the illegal behavior and remove the tea products that did not meet the requirements. On December 12, 2023, Yixing Municipal Market Supervision Bureau again sampled and inspected another Yixing black tea gift box (specification: 125g x 2) sold by the party. After inspection by Anhui Qingxi Testing Technology Co., Ltd., the tea gift box was 340mm long, 250mm wide, 71mm high, and the packaging void ratio was 46%, which did not meet the requirements of GB23350-2021 "Restrictions on Excessive Packaging of Goods for Food and Cosmetics" regarding "single piece net content Q> 50g, packaging void ratio ≤30%".

The party's behavior violated the provisions of Article 68, paragraph 2 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes", and was an act of producers and operators failing to comply with the mandatory standards for restricting excessive packaging of goods and refusing to correct it as stipulated in Article 105 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes". The Yixing Municipal Market Supervision Bureau imposed administrative penalties in accordance with Article 105 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes".

3. The Market Supervision Bureau of Pujiang County, Zhejiang Province investigated and dealt with the case of Xiong Moujie selling tea with excessive packaging costs.

On February 21, 2024, the Market Supervision Bureau of Pujiang County, Zhejiang Province imposed an administrative penalty of 2,000 yuan on Xiong Moujie (hereinafter referred to as the party) for failing to comply with the mandatory standards for restricting excessive packaging of goods and refusing to correct the behavior.

On September 28, 2023, when the Pujiang County Market Supervision Bureau inspected the party based on consumer complaints, it was found that it was selling "Pujiang Chunhao" green tea (500g/box) through the WeChat circle of friends "Wuyouguo (Wuyou Tea Shop)", with a sales price of 200 yuan/box (the party purchased the tea by itself and packaged it into finished products). The purchase invoice showed that the purchase price of the packaging box (including 2 tea cans and 1 outer box) was 50 yuan/set. The total cost of all packaging except the initial packaging (aluminum-plastic bag) was 25% of the sales price of the commodity, which did not comply with GB23350-2021 "Requirements for Restricting Excessive Packaging of Food and Cosmetics" that "production organizations should take measures to control the cost of all packaging except packaging that is in direct contact with the contents to no more than 20% of the product sales price". A "Notice of Correction" was issued on the spot, requiring the party to immediately correct and stop selling over-packaged tea products. On January 24, 2024, a review revealed that the "Jin Jun Mei" (500 grams/box, which was packaged and produced by the party itself and then sold to the outside) sold by the party through WeChat business on its WeChat platform was marked with a selling price of 998 yuan/box, and the purchase invoice showed that the solid wood paint packaging box used (including 12 small tea cans and 1 outer box) was purchased at a price of 265 yuan/set. The total cost of all packaging except the initial packaging (aluminum-plastic bag) was 26.55% of the sales price of the product, which does not comply with GB23350-2021 "Requirements for Restricting Excessive Packaging of Food and Cosmetics" that "production organizations should take measures to control the cost of all packaging except for packaging that is directly in contact with the contents to no more than 20% of the product sales price."

The party's behavior violated the provisions of Article 68, paragraph 2 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Waste", and was an act of producers and operators failing to comply with the mandatory standards for restricting excessive packaging of goods and refusing to correct the behavior as stipulated in Article 105 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Waste". The Pujiang County Market Supervision Bureau imposed administrative penalties in accordance with Article 105 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Waste".

4. The Songyang County Market Supervision Bureau of Zhejiang Province investigated and dealt with the case of Songyang County Liu Yuhao Tea Co., Ltd. failing to comply with the mandatory standards for restricting excessive packaging of goods

On February 6, 2024, the Songyang County Market Supervision Bureau of Zhejiang Province imposed an administrative penalty of 3,276 yuan on Songyang County Liu Yuhao Tea Co., Ltd. (hereinafter referred to as the party) for failing to comply with the mandatory standards for restricting excessive packaging of goods and refusing to correct the behavior.

On November 16, 2023, the Lishui Municipal Market Supervision Bureau, relying on the "Lishui City Online Transaction Monitoring Platform", discovered that the Taobao online store "Gu Li's Tea" (business license: Songyang County Liu Yuhao Tea Co., Ltd.) was suspected of operating over-packaged tea products. On November 24, 2023, the Songyang County Market Supervision Bureau inspected the business premises of the party concerned based on the case clues transferred by the Lishui Municipal Market Supervision Bureau. A golden bud tea gift box (specification model is 125g x 2 cans/box) was found on the spot. After manual measurement, the tea packaging box is 361mm long, 264mm wide, and 83mm high. The inner packaging is two iron box rectangles with dimensions of 105mm long, 75mm wide, and 170mm high. The packaging void ratio is 59%, which does not comply with the provisions of GB23350-2021 "Requirements for Restricting Excessive Packaging of Food and Cosmetics" regarding "single piece net content Q£¾50g, packaging void ratio ≤30%". The Songyang County Market Supervision Bureau issued a "Notice of Correction" on the spot, requiring the party concerned to immediately correct the illegal behavior and remove tea products that do not meet the requirements. On December 14, 2023, the Songyang County Market Supervision Bureau re-inspected the party concerned and found a golden bud tea gift box (specification model is 125 grams x 2 cans/box). After manual measurement, the tea packaging box is 345mm long, 235mm wide, and 88mm high. The inner packaging is two iron box rectangles with a length of 168mm, a width of 75mm, and a height of 105mm. After entrusting the Zhejiang Institute of Metrology to conduct sampling inspection, the packaging void ratio is 60%, which does not meet the requirements of GB23350-2021 "Requirements for Restricting Excessive Packaging of Food and Cosmetics" regarding "single piece net content Q£¾50g, packaging void ratio ≤30%".

The party's behavior violated the provisions of Article 68, paragraph 2 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes", and was an act of producers and operators failing to comply with the mandatory standards for limiting excessive packaging of goods and refusing to correct the behavior as stipulated in Article 105 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes". The Songyang County Market Supervision Bureau imposed administrative penalties in accordance with Article 105 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes".

5. The Market Supervision Bureau of Laoshan District, Qingdao City, Shandong Province investigated and dealt with the case of Rixiang Tea Shop in Laoshan District selling tea with excessive packaging voids

On January 31, 2024, the Market Supervision Bureau of Laoshan District, Qingdao City, Shandong Province, imposed an administrative penalty of 2,000 yuan on Rixiang Tea Shop in Laoshan District (hereinafter referred to as the party) for failing to comply with the mandatory standards for limiting excessive packaging of goods and refusing to correct the behavior.

On September 22, 2023, the Market Supervision Bureau of Laoshan District, Qingdao City, carried out a special inspection on excessive packaging of tea. A Pu'er tea with a net content of 80g (40gx2) sold by the party was measured manually on the spot. The length, width and height of the gift box were 225mm, 150mm and 145mm respectively, and the packaging void ratio was 78.75%; another Baihao Yinzhen with a net content of 40g (5gx8), the length, width and height of the gift box were 285mm, 160mm and 70mm respectively, and the packaging void ratio was 78.75%. The rate was 83.7%. The above two tea gift boxes did not meet the requirements of GB23350-2021 "Requirements for Restricting Excessive Packaging of Food and Cosmetics" regarding "single piece net content 30g < Q ≤ 50g, packaging void ratio ≤ 40%" and "single piece net content 1g < Q ≤ 5g, packaging void ratio ≤ 70%". A "Notice of Correction" was issued on the spot, requiring the parties to immediately correct the above-mentioned illegal acts and at the same time investigate and remove other over-packaged tea products. On January 10, 2024, law enforcement officers conducted a "look back" and found that the orange peel substitute tea (net content 80g, manufacturer: Fujian Richun Industrial Co., Ltd.) sold by the party was measured manually on the spot. The length, width and height of the gift box were 165.7mm, 165.7mm, and 197.3mm, and the packaging void rate was 80.8%, which did not meet the requirements of GB23350-2021 "Requirements for Restricting Excessive Packaging of Goods for Food and Cosmetics" regarding "single net content Q>50g, packaging void rate ≤30%".

The party's behavior violated the provisions of Article 68, paragraph 2 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes", and was an act of producers and operators failing to comply with the mandatory standards for restricting excessive packaging of goods and refusing to correct it as stipulated in Article 105 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes" and refusing to correct it. The Laoshan District Market Supervision Bureau imposed administrative penalties in accordance with Article 105 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes" and reported the clues to the market supervision department where the tea manufacturer was located.

6. The Market Supervision Bureau of Shangqiu City, Henan Province, investigated and dealt with the case of Shangqiu Haoyu Trading Co., Ltd. selling tea with excessive void ratio in packaging.

On September 20, 2023, the Market Supervision Bureau of Shangqiu City, Henan Province, imposed an administrative penalty of 2,000 yuan on Shangqiu Haoyu Trading Co., Ltd. (hereinafter referred to as the party) for failing to comply with the mandatory standards for restricting excessive packaging of goods and refusing to correct the situation.

On September 12, 2023, during a special inspection on restricting excessive packaging of goods, the Shangqiu Municipal Market Supervision Bureau found that the rectangular "Rui Fu" tea gift boxes (net content: 70g/box) being sold by the party concerned had a length, width and height of 280mm, 280mm and 70mm respectively. After manual on-site measurement, the packaging void ratio was 83.4%, which did not comply with the requirements of GB23350-2021 "Requirements for Restricting Excessive Packaging of Goods for Food and Cosmetics" regarding "For single unit net content Q£¾50g, the packaging void ratio shall be ≤30%". A "Notice of Correction" was issued on the spot, requiring the party concerned to immediately correct the illegal behavior and remove other excessively packaged goods in the store. On September 15, 2023, a review found that the rectangular gift boxes of "Zijin Bailan Bai Mudan Pressed White Tea" being sold contained 6 boxes of canned tea, each weighing 30 grams (principal (distributor): Bama Tea Co., Ltd.; principal (manufacturer): Fujian Dingke Tea Co., Ltd.). After manual on-site measurement, the length, width and height of the gift boxes were 280mm, 280mm and 80mm respectively, and the packaging void ratio was 62.7%, which did not comply with the requirements of GB23350-2021 "Requirements for Restricting Excessive Packaging of Food and Cosmetics" that "for single items with a net content of 15g <Q ≤30g, the packaging void ratio is ≤50%".

The party's behavior violated the provisions of Article 68, paragraph 2 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes", and was an act of producers and operators failing to comply with the mandatory standards for limiting excessive packaging of goods and refusing to correct the behavior as stipulated in Article 105 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes" and refusing to correct the behavior. The Shangqiu Municipal Market Supervision Bureau imposed administrative penalties in accordance with Article 105 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes" and reported the clues to the market supervision department where the tea producer is located.

7. The Market Supervision Bureau of Ezhou City, Hubei Province investigated and dealt with the case of Ezhou Huarong Baixin Supermarket Co., Ltd. selling tea with excessive packaging void ratio

On February 21, 2024, the Market Supervision Bureau of Ezhou City, Hubei Province, imposed an administrative penalty of 2,000 yuan on Ezhou Huarong Baixin Supermarket Co., Ltd. (hereinafter referred to as the party) for failing to comply with the mandatory standards for limiting excessive packaging of goods and refusing to correct the behavior.

On November 2, 2023, the Ezhou Municipal Market Supervision Bureau conducted a special sampling inspection on excessive packaging of a "Fragrant Jin Junmei" tea gift box with a net content of 125 grams and a production date of 2023/01/06, which was sold by the party. After entrusting Shanghai Huace Pinbiao Testing Technology Co., Ltd. to conduct the test, the packaging void ratio was 60.7%, which did not meet the requirements of GB23350-2021 "Requirements for Restricting Excessive Packaging of Commodities for Food and Cosmetics" regarding "For single items with a net content of Q>50g, the packaging void ratio is ≤30%". On January 3, 2024, the Ezhou Municipal Market Supervision Bureau served the "Test Report" of the above-mentioned tea gift box to the party, and issued a "Notice of Order to Correct", requiring the party to correct the above-mentioned illegal acts and remove the relevant over-packaged tea products before January 9, 2024. On January 11, 2024, when law enforcement officers conducted a "look back" on excessive packaging of tea, they found that a "Yi Xiangchun Jin Jun Mei" tea gift box sold by the party concerned (net content of 7 grams/times; 43 bags, nominal date of 2023/12/15, manufacturer: Yi Xiangchun Tea Co., Ltd., Wuhu City, Anhui Province) was measured manually on site. The length, width and height of the initial packaging of the circumscribed rectangular block were 280mm, 37.7mm and 93mm respectively, and the packaging void ratio was 60.15%, which did not comply with the requirements of GB23350-2021 "Requirements for Restricting Excessive Packaging of Commodities, Food and Cosmetics" that "for single items with a net content of 5

The party's behavior violated the provisions of Article 68, paragraph 2 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes", and was an act of producers and operators failing to comply with the mandatory standards for limiting excessive packaging of goods and refusing to correct the behavior as stipulated in Article 105 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes" and refusing to correct the behavior. The Ezhou Municipal Market Supervision Bureau imposed administrative penalties in accordance with Article 105 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes" and reported the clues to the market supervision department where the tea producer is located.

8. The Qingchuan County Market Supervision Bureau of Sichuan Province investigated and dealt with the case of the Sichuan Agricultural and Local Products Business Department in Qingxi Town selling tea with excessive packaging voids

On January 4, 2024, the Qingchuan County Market Supervision Bureau of Sichuan Province imposed an administrative penalty of 2,000 yuan on the Sichuan Agricultural and Local Products Business Department in Qingxi Town, Qingchuan County (hereinafter referred to as the party) for failing to comply with the mandatory standards for limiting excessive packaging of goods and refusing to correct the behavior.

On November 2, 2023, the Qingchuan County Market Supervision Bureau conducted a supervision and inspection on restricting excessive packaging of tea and conducted an investigation on the "Hechangju Dahongpao" tea gift box (marked with net content: 100g, batch number and production date: 2021/12/12) being sold by the party concerned. Upon investigation, it was found that the tea gift box was purchased by the party concerned from Guangyuan Hechang Culture Communication Co., Ltd., and Guangyuan Hechang Culture Communication Co., Ltd. purchased bulk tea from Wuyishan Xiancong Ecological Tea Co., Ltd. and then packaged it for sale. Through manual on-site measurement, the length, width and height of the initial packaging of the circumscribed rectangular block were measured to be 34.2cm, 22.4cm and 8.3cm respectively, and the packaging void ratio was 79.5%, which does not comply with the provisions of GB23350-2021 "Requirements for Restricting Excessive Packaging of Food and Cosmetics" regarding "For single unit net content Q>50g, the packaging void ratio is ≤30%". According to the law, a "Notice of Correction" was issued to the party concerned, requiring the party concerned to correct the above-mentioned illegal acts and remove the excessively packaged tea products from the shelves before November 7, 2023. On December 11, 2023, law enforcement officers reviewed the situation of the party being ordered to correct and found that 4 boxes of the above products were still placed on sale in the party's business premises. After entrusting Guangyuan Metrology Verification and Testing Institute to conduct sampling inspection, the packaging void rate was 79%, which did not meet the requirements of GB23350-2021 "Food and Cosmetics with Restrictions on Excessive Packaging of Goods" regarding "For single items with a net content of Q > 50g, the packaging void rate is ≤30%".

The party's behavior violated the provisions of Article 68, paragraph 2 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes", and was an act of producers and operators failing to comply with the mandatory standards for restricting excessive packaging of goods and refusing to correct it as stipulated in Article 105 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes". The Qingchuan County Market Supervision Bureau imposed administrative penalties in accordance with Article 105 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes". On January 25, 2024, the clues were reported to the market supervision department where Guangyuan Hechang Cultural Communication Co., Ltd. was located.

9. The Market Supervision Bureau of Duyun City, Guizhou Province, investigated and dealt with the case of Duyun Meng A Mei Tea House selling tea with excessive void ratio in packaging.

On January 11, 2024, the Market Supervision Bureau of Duyun City, Guizhou Province, imposed an administrative penalty of 2,500 yuan on Duyun Meng A Mei Tea House (hereinafter referred to as the party) for failing to comply with the mandatory standards for restricting excessive packaging of goods and refusing to correct the situation.

On September 23, 2023, the Duyun Municipal Market Supervision Bureau inspected the business premises of the party concerned and conducted a random inspection of the Duyun Maojian tea being sold (net content: 250g, 125g¡Á2, shelf life: 24 months, manufacturer: Duyun Jianjiang Tea Co., Ltd.). After manual on-site measurement, the above tea packaging box was 36cm long, 24cm wide, and 9.5cm high, with a packaging void rate of 60.4%, which did not meet the requirements of GB23350-2021 "Restrictions on Excessive Packaging of Goods, Food and Cosmetics" regarding "single net content Q > 50g, packaging void rate ≤ 30%". The law enforcement officers issued a "Notice of Correction" on the spot, requiring the party concerned to immediately correct the illegal behavior and remove the relevant tea packaging. On November 14, 2023, the Duyun Municipal Market Supervision Bureau re-inspected the party concerned and found that the same tea packaging that did not meet the standards was still on sale on the party's shelves. After investigation, it was found that the tea suspected of over-packaging was sold after being packaged in boxes ordered by Meng Amei Tea House from Duyun Maojian Tea Packaging Factory. On December 4, 2023, after inspection by the Guizhou Provincial Product Quality Inspection and Testing Institute, the packaging void rate of the above tea was 60.9%, which did not meet the requirements of GB23350-2021 "Food and Cosmetics with Restrictions on Excessive Packaging of Goods" regarding "single net content Q > 50g, packaging void rate ≤ 30%".

The party's behavior violated the provisions of Article 68, paragraph 2 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes", and was an act of producers and operators failing to comply with the mandatory standards for restricting excessive packaging of goods and refusing to correct it as stipulated in Article 105 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes". The Duyun Municipal Market Supervision Bureau imposed administrative penalties in accordance with the provisions of Article 105 of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes", and ordered the Duyun Maojian Tea Packaging Factory to stop selling boxes that did not meet the mandatory standards and recall related products.

10. Beijing Daxing District Market Supervision Bureau corrected the behavior of Beijing Lanxixuan Tea Culture Exchange Co., Ltd. in producing tea with excessive packaging void ratio

On January 25, 2024, Beijing Daxing District Market Supervision Bureau ordered Beijing Lanxixuan Tea Culture Exchange Co., Ltd. (hereinafter referred to as the party) to correct its failure to comply with the mandatory standards for restricting excessive packaging of goods. On February 5, 2024, after re-examination, the party has made rectifications.

On January 10, 2024, the Daxing District Market Supervision Bureau received a case assignment notice from the Beijing Municipal Market Supervision Bureau regarding the party involved¡¯s suspected failure to comply with the mandatory standards for restricting excessive packaging of goods and an inspection and testing report issued by the Beijing Product Quality Supervision and Inspection Institute.
