Beijing, Tianjin and Hebei publishes price stabilization, quality assurance and compliance tips

The New Year's Day and Spring Festival of 2024 are approaching. Today, the market supervision departments of Beijing, Tianjin and Hebei jointly remind the following matters related to the prices, food safety and product quality of important livelihood commodities in Beijing, Tianjin and Hebei during the New Year's Day and Spring Festival:

(i) All operators must strictly abide by the "Price Law of the People's Republic of China", "Anti-Unfair Competition Law of the People's Republic of China", "Food Safety Law of the People's Republic of China", "Product Quality Law of the People's Republic of China", "Regulations on Clear Pricing and Prohibition of Price Fraud" and other laws and regulations, consciously regulate prices and competition behaviors, adhere to the bottom line of food safety, and strictly control quality and safety.

(ii) All operators must conscientiously implement relevant regulations on clear pricing. The price must be true and accurate, the goods and labels must be aligned, and the labels must be eye-catching. Price changes must be adjusted in a timely manner. It is not allowed to sell goods or provide services at a price other than the marked price, and it is not allowed to charge any fees that are not marked. Operators who sell goods or provide services through the Internet or other means shall clearly mark prices through the network page in text, images, etc.

(III) All operators shall not use false or misleading price means to deceive consumers or other operators to trade with them. When selling goods or providing services through various means such as offline operation of physical stores, e-commerce platforms, online travel platforms, APPs, live marketing, etc., price fraud such as low prices to deceive high prices, raising prices first and then discounting, false discounts, and failure to fulfill price commitments shall not occur.

(IV) All large wholesale markets, chain supermarkets, restaurants, pharmacies, etc. must ensure that the prices of rice, flour, grains, oils, fruits, vegetables, meat, eggs, milk, seasonal specialty foods, and medicines for colds, fevers, frostbite, and injuries caused by cold weather are basically stable. They shall not fabricate or spread price increase information, drive up prices, or hoard goods to disrupt market order. Operators of people's livelihood commodities such as grains, oils, meat, eggs, vegetables, and milk must actively fulfill their social responsibilities and implement the requirements of ensuring supply and stabilizing prices.

(V) All catering operators shall consciously regulate their pricing behavior. The price content of in-store menus, price tags or other ordering tools in the store shall be consistent. If different prices are implemented due to different characteristics such as origin and specifications, the product name and price shall be marked separately, and "two sets of menus" shall not appear.

For the sale of "small portions" or "half portions", the price of "small portions" or "half portions" shall be marked; the requirements for clear price marking shall be standardized and implemented during the sale of New Year's Eve dinners, and prices shall be set reasonably without concealing additional price conditions.

(VI) Operators of hotel accommodation, entertainment performances, car and electric bicycle charging stations, cinemas, tourist attractions, characteristic tourist streets, temple fairs and garden fairs shall strictly do a good job of clear price marking, shall not charge fees that are not marked, shall not sell goods or provide services at a price higher than the marked price, and shall not use false or misleading price means to deceive consumers or other operators. Hotels (including B&Bs) that charge for room supplies should indicate the scope and standard of charges. Those that provide paid services such as laundry and ticket booking should indicate the charge items and standard of charges. They should keep their promises and abide by the contractual agreements, and should not deliberately breach the contract and temporarily increase the price in violation of the price promise. Tourist attractions should make public announcements of ticket prices, tour guide explanations, and amusement facilities, and strictly regulate the price behavior of small commodities, catering and other extended service operators in scenic spots. They should not fail to implement government pricing, privately set up "gardens in gardens", arbitrarily add charging items, increase ticket prices in disguise, engage in price fraud, fail to clearly mark prices according to regulations, and fail to implement relevant exemptions and preferential measures for special groups.

(VII) All passenger transport companies, taxi companies, online car-hailing companies, railways, highways, airlines, rescue consignments, parking fees and other units should consciously regulate price behavior and maintain the price order of the transportation passenger transport market. Parking fee operating units should do a good job of clearly marking prices according to regulations, and implement exemptions and preferential policies for relevant vehicles.

(VIII) All providers of trading venues, such as stores, shopping malls, markets, and online trading platform operators, shall implement their principal responsibilities, strengthen the regulation and guidance of operators in the venues (platforms), and strengthen the prior review of price promotion plans.

(IX) Online trading operators shall avoid the following behaviors: the price marked on the homepage or other prominent positions is lower than the price marked on the details page; the scope and rules of the announced promotional activities are inconsistent with the scope and rules of the actual promotional activities; other false or misleading price markings and price promotion behaviors.

(X) Operators shall not make false or misleading commercial propaganda about the performance, function, quality, sales status, user evaluation, honors, etc. of their products, deceive or mislead consumers. They shall not help other operators to carry out false propaganda by organizing false transactions or false rankings.

(XI) Food producers and operators must strictly implement the main responsibility for food safety, establish and improve the food safety management system, engage in production and operation activities in accordance with food safety laws, regulations and food safety standards, do a good job in the supply, procurement and storage of raw materials, and resolutely put an end to the production and operation of expired, corrupt, deteriorated, counterfeit and inferior food.

(XII) All catering units that provide wedding banquets, New Year's Eve dinners, take-out and other catering services must strictly manage the procurement of raw materials, standardize business operations, do a good job in anti-food waste propaganda, guide consumers to order food reasonably, and prevent catering waste.

(XIII) All production and sales units of key industrial products such as household heating equipment, household gas appliances, toys and other children's products, disposable plastic tableware, etc. must tighten the main responsibility for product quality and safety, establish and improve the product quality and safety management system, implement the certificate and ticket request system, strictly produce and sell industrial products in accordance with national standards, and strictly prevent unqualified products from entering the market.

The market supervision departments of Beijing, Tianjin and Hebei said that operators in the three places should carefully compare with the above requirements, establish and improve the internal price management mechanism, conduct self-inspection and self-correction in a timely manner, and properly handle all kinds of disputes. When consumers' legitimate rights and interests are damaged or they discover illegal business practices, they can call the local 12345 or 12315 hotline to complain and report. The market supervision departments of Beijing, Tianjin and Hebei will strengthen the coordinated supervision and law enforcement of the stable prices and quality of important livelihood commodities during the New Year's Day and Spring Festival, keep a close eye on the clues of complaints and reports, investigate and deal with illegal activities such as prices, food safety, product quality, and unfair competition in accordance with the law, and work together to create a consumer environment where people can buy comfortably, eat safely, and use products with peace of mind, and escort the people of Beijing, Tianjin and Hebei to spend a peaceful and happy New Year.
