Final review of anti-dumping measures on polyoxymethylene copolymers
On October 23, 2017, the Ministry of Commerce issued Announcement No. 61 of 2017, imposing anti-dumping duties on imports of copolymer polyoxymethylene originating from South Korea, Thailand and Malaysia. After a renaming review, the measure will expire on October 23, 2022. Currently, the corporate tax rate in South Korea is 6.2%-30.4%, the corporate tax rate in Thailand is 18.5%-34.9%, and the corporate tax rate in Malaysia is 8.0%-9.5%.
On July 12, 2022, the Ministry of Commerce received an application for final review of anti-dumping measures submitted by Yunnan Yuntianhua Co., Ltd., China Energy Ningxia Coal Co., Ltd., Kaifeng Longyu Chemical Co., Ltd., Yankuang Lunan Chemical Co., Ltd., Tangshan Zhonghao Chemical Co., Ltd. and CNOOC Tianye Chemical Co., Ltd. on behalf of Chinese industries. The applicant claims that if the anti-dumping measures are terminated, the dumping of imported copolymer polyoxymethylene originating in South Korea, Thailand and Malaysia on China may continue or reoccur, and the damage caused to the Chinese industry may continue or reoccur, and requests the Ministry of Commerce to conduct a final review investigation on the imported copolymer polyoxymethylene originating in South Korea, Thailand and Malaysia, and maintain the anti-dumping measures imposed on the imported copolymer polyoxymethylene originating in South Korea, Thailand and Malaysia.
In accordance with the relevant provisions of the Anti-dumping Regulations of the People's Republic of China, the Ministry of Commerce reviewed the qualifications of the applicant, the relevant information of the investigated products and similar Chinese products, the import situation of the investigated products during the implementation of the anti-dumping measures, the possibility of the dumping continuing or reoccurring, the possibility of the damage continuing or reoccurring, and the relevant evidence. The existing evidence shows that the applicant meets the provisions of Articles 11, 13 and 17 of the Anti-dumping Regulations of the People's Republic of China on industries and industry representativeness, and is qualified to apply on behalf of the Chinese copolymer polyoxymethylene industry. The investigation authority believes that the applicant's claims and the surface evidence submitted meet the requirements for filing a final review.
In accordance with Article 48 of the Anti-dumping Regulations of the People's Republic of China, the Ministry of Commerce has decided to conduct a final review investigation on the anti-dumping measures applicable to imports of copolymer polyoxymethylene originating in South Korea, Thailand and Malaysia from October 24, 2022. The relevant matters are hereby announced as follows:
1. Continue to implement anti-dumping measures
According to the suggestion of the Ministry of Commerce, the Tariff Committee of the State Council has decided that during the final review investigation of anti-dumping measures, anti-dumping duties will continue to be levied on imports of copolymer polyoxymethylene originating in South Korea, Thailand and Malaysia in accordance with the scope of taxable products and tax rates announced by the Ministry of Commerce in the annex.

II. Review Investigation Period
The dumping investigation period for this review is from July 1, 2021 to June 30, 2022, and the industry injury investigation period is from January 1, 2018 to June 30, 2022.
III. Scope of products under review
The scope of products under review is the products to which the original anti-dumping measures apply, which is consistent with the scope of products to which the anti-dumping measures announced by the Ministry of Commerce are applicable as listed in the annex, as follows:
Product name: Copolymer polyoxymethylene, also known as polyoxymethylene copolymer, or polyoxymethylene copolymer.
English name: PolyformaldehydeCopolymer, or PolyoxymethyleneCopolymer, or Copolymer-typeAcetalResin, or AcetalCopolymer, etc., the English name is usually referred to as POMCopolymer.
Chemical formula: -[CH2-O]n-[CH2-O-CH2-CH2]m-(n>m).
Physical and chemical properties: Copolymer polyoxymethylene is synthesized from formaldehyde, and is a thermoplastic resin with a -CH2-O- main chain and -[CH2-O-CH2-CH2]- embedded bonds (-CH2-O- content is greater than 50% by weight). It is usually a milky white or light yellow granular solid at room temperature and meets the following performance indicators:
Main uses: Copolymer polyoxymethylene has good comprehensive mechanical properties such as high mechanical strength, high fatigue resistance, and high creep resistance. It can partially replace metal materials such as copper, zinc, tin, and lead. It can be directly used or modified in automotive parts, electronic appliances, industrial machinery, daily necessities, sports equipment, medical equipment, pipe fittings, construction materials and other fields.
This product is classified in the "Tariff of the People's Republic of China": 39071010, 39071090. Other products such as homopolymer polyoxymethylene and modified polyoxymethylene under these two tariff numbers are not within the scope of the products under investigation this time.
IV. Review Content
The content of this review investigation is: if the anti-dumping measures on imports of copolymer polyoxymethylene originating in South Korea, Thailand and Malaysia are terminated, whether dumping and damage may continue or reoccur.
V. Registration for Participation in the Investigation
Interested parties may register with the Trade Remedy Investigation Bureau of the Ministry of Commerce to participate in this anti-dumping expiration review investigation within 20 days from the date of publication of this announcement. Interested parties participating in the investigation shall provide basic identity information, the quantity and amount of the investigated products exported or imported to China, the quantity and amount of similar products produced and sold, and related information in accordance with the "Reference Format for Registration for Participation in the Investigation". The "Reference Format for Registration for Participation in the Investigation" can be downloaded from the Trade Remedy Investigation Bureau sub-website of the Ministry of Commerce website.
Interested parties who register to participate in this anti-dumping investigation shall submit an electronic version through the "Trade Remedy Investigation Information Platform" (https://etrb.mofcom.gov.cn) and submit a written version at the same time according to the requirements of the Ministry of Commerce. The electronic version and the written version shall have the same content and consistent format.
The interested parties referred to in this announcement refer to individuals and organizations as specified in Article 19 of the Anti-dumping Regulations of the People's Republic of China.

VII. Comments on the case
If the interested parties need to comment on the product scope and applicant qualifications of this investigation, the investigated countries (regions) and other related issues, they may submit written opinions to the Trade Remedy Investigation Bureau of the Ministry of Commerce within 20 days from the date of this announcement.
VIII. Investigation Methods
According to Article 20 of the Anti-dumping Regulations of the People's Republic of China, the Ministry of Commerce may use questionnaires, sampling, hearings, on-site inspections and other methods to understand the situation and conduct investigations with relevant stakeholders.
In order to obtain the information required for the investigation of this case, the Ministry of Commerce usually issues questionnaires to stakeholders within 10 working days from the deadline for registration for participation in the investigation as stipulated in this announcement. Interested parties can download the questionnaires from the Trade Remedy Investigation Bureau sub-website of the Ministry of Commerce website.
Interested parties shall submit complete and accurate answers within the specified time. The answers shall include all the information required by the questionnaire.
IX. Submission and Processing of Information
When interested parties submit comments, answers, etc. during the investigation, they shall submit an electronic version through the "Trade Remedy Investigation Information Platform" (https://etrb.mofcom.gov.cn) and submit a written version at the same time according to the requirements of the Ministry of Commerce. The electronic version and the written version shall have the same content and the same format.
If the information submitted by the interested party to the Ministry of Commerce needs to be kept confidential, the interested party may make a request to the Ministry of Commerce for confidential treatment of the relevant information and explain the reasons. If the Ministry of Commerce agrees to its request, the interested party applying for confidentiality shall also provide a non-confidential summary of the confidential information. The non-confidential summary shall contain sufficient and meaningful information so that other interested parties can have a reasonable understanding of the confidential information. If the non-confidential summary cannot be provided, the reason shall be stated. If the information submitted by the interested party does not state that it needs to be kept confidential, the Ministry of Commerce will regard the information as public information.
X. Consequences of Non-cooperation
According to Article 21 of the Anti-dumping Regulations of the People's Republic of China, when the Ministry of Commerce conducts an investigation, the interested party shall truthfully reflect the situation and provide relevant information. If the interested party fails to truthfully reflect the situation, provide relevant information, or fails to provide necessary information within a reasonable time, or seriously hinders the investigation in other ways, the Ministry of Commerce may make a ruling based on the facts already obtained and the best information available.
XI. Investigation Period
This investigation shall commence on October 24, 2022 and shall be completed before October 24, 2023 (excluding this day).
